Fair Consideration Framework (FCF): what employers must do
Before filing an EP application, many roles require a qualifying job ad on MyCareersFuture (MCF). Here’s the plain‑English version of the rules and the practical steps.
1) When the FCF / MCF ad applies
- Most EP roles require an MCF ad for the prescribed period unless the employer qualifies for an exemption (e.g., turnover below threshold, role is intra‑company transferee, or selected senior roles).
- Recheck the latest MOM policy before posting — thresholds and sectors may change.
2) Writing a compliant MCF ad
- Use a clear, non‑discriminatory title and description. Avoid nationality, age or gender preferences.
- Describe responsibilities and minimum qualifications accurately; don’t over‑specify niche criteria unless business‑critical.
- State realistic salary range; ensure alignment with the EP offer and market benchmarks.
3) Publishing & evidence
- Post on MCF for at least the required number of calendar days; keep screenshots and reference IDs.
- Document your shortlisting rationale — it may be requested by MOM if the case is reviewed.
4) Common mistakes to avoid
- Posting an ad with a different job title or scope than the EP application.
- Setting a salary below the stated range when issuing the offer.
- Not demonstrating local hiring efforts or interviewing relevant local applicants.
Practical tip: keep your JD and MCF ad text in sync. If the role evolves after posting, update the ad or restart the window to avoid downstream questions.
